Three possible relationships
The three arrangements this page distinguishes:
- Personal-use processing: Processing food that the owner will consume or use personally, not placed into commercial channels.
- Commercial food processing: Processing food that enters commerce, which triggers the food-establishment, registration, labeling and sales obligations that apply.
- Manufacturing on behalf of another company: Producing product for another business under its brand or specification, which raises contract-manufacturing questions such as whose registration covers the product and facility.
Questions that determine the classification
The classification follows the answers to these questions:
- What is the product's final destination?: Personal use, commercial sale, or a brand owner's inventory.
- Whose name is on the product?: The producer's, the client's, or a distributor's.
- Who owns the food at each step?: Ownership during and after processing.
- Who gets paid and for what?: A processing fee, a wholesale sale, or a manufacturing contract.
- Which establishment is registered?: Which legal operator holds the permits and registrations involved.
