Selling Across State Lines
Selling across state lines can trigger federal requirements in addition to the destination state's requirements, because interstate commerce is where FDA's core jurisdiction operates. For pet food, the state layer repeats per state: registration in one state does not cover the country. Plan for both layers, never just one.

Interstate commerce and the federal layer
When a product moves across state lines, FDA's jurisdiction over most human and animal foods in interstate commerce is at its strongest. Facility registration where applicable, CGMP, labeling and the other federal rules apply independent of any single state's approval.
The state layer repeats per state
For every state where the product is sold or shipped:
- Pet food registration: Pet food may require registration in multiple states; each state runs its own program.
- Feed licensing: Commercial feed licensing may apply in several states.
- Cottage food limits: Shipped and online sales may fall outside a state's cottage-food allowance entirely.
- Labeling additions: States can add labeling requirements beyond the federal baseline.
